The American Pharmaceutical Association (APA) is considering a lawsuit against Pfizer, makers of Viagra, for marketing a fake and expensive version of the medication known as "sildenafil citrate."
Pfizer has been accused of marketing Viagra, and Pfizer is the owner of the patent for Viagra. Since Viagra became available in 1998, the FDA has banned it from making generic copies of the pills.
In 2007, the APA ordered Pfizer to update the Viagra patent, but the FDA's ruling has since prevented Pfizer from marketing the drug again.
The APA, which also has the lawsuit, is concerned the FDA's ruling is the result of a loophole in the patent. But the APA's attorney, Michael Galson, says Pfizer is still trying to get a generic version of Viagra.
"There is no 'patent cliff' at which that happens," said Galson, who filed suit in January. "The APA is now working on a way to ensure that we don't have a generic version of Viagra on the market."
He says the APA has been monitoring Pfizer's marketing efforts for several years, and it's time for the FDA to step in and say that the company is still using Viagra to market a medicine.
In a statement to Reuters, Pfizer spokesperson Frank Scholl said, "Pfizer's patent on sildenafil citrate is set to expire in December 2008. The FDA has not yet approved Viagra or sildenafil citrate for use in treating erectile dysfunction. Pfizer is not responsible for the timing of any of the adverse events described in this news release."
